Edenside Kelso TD5 7BS 2003-10-15 Re: Cintec International Limited v John Parkes and Martin Frost Dear Mr Radford, Upon the instructions of the embryo board of Dellex International Plc I write on their behalf, Mr John Parkes’s behalf, and my own. Last night we considered the above court action and the contents of Mr David Liddle’s letter. This morning I became aware of your response to Mr Liddle’s letter. 1.In terms of the order discussed
while I was in court I had though it had been completed.
2.Re: the order prepared as the
result of Mr Justice Laddie’ judgement I await a response from our
advisors which I will have later to day though prima facie I cannot
concur to those elements which appear to run contrary to the
transcripts.
3.Mr David Liddle’s letter is his
perception of events and no doubt his motives are good. It is true I
have urged temperance and would have wished a negotiated exit but that
was not possible. It is true that Mr John Parkes became very stressed
as his life degenerated into a ‘hell on earth’ on account of this
action. Regrettably, Mr Halstead’s without prejudice letter save to
costs prompted a chain of events of which a Greek tragedy would have
been proud. John is a very highly intelligent man but first and
foremost he is a soldier of the old school who will fight for his
belief.
4. Payment of costs to a
litigant in person is obviously a very emotional and painful subject.
That said, we lost, Cintec won. To assist such cost and payment
deliberations I enclose a sheet setting out what I perceive as my
assets and liabilities, and John Parkes assets and liabilities. Our
proposal would be that the Plc pays your clients costs via the purchase
of Mr Parkes’ patents which will be fulfilled from out of the
subscription capital. This may take six to eight weeks from to day. In
the meantime I propose to deliver to you one painting by Richard Parkes
Bonnington which will provide more than adequate security for your
client’s costs.
