office of THIRL originates
from the distant past when a thirl was a body servant or retainer to a
noble or chief. Perhaps, one of the most famous examples of a thirl is
when King Harold's house carls
or thirls put up their famous
last stand at the Battle of Hastings
1066 which
heralded the Norman conquest of Britain.
In Scotland the ancient institution or custom of thirlage has long been recognised though the Thirlage Act 1799 restricted its use. In essence thirlage is a trade restraint or monopoly, perhaps not totally unlike a modern day franchise. The famous Scots law writer Rankine described thirlage as a relict of an old form of feudal service yet the history of thirlage dates to a free era prior to the arrival of the Normans and their French ways.
