The Horseshoe Gallery v Frost & McNamara

Dear Mr Fairlie,

I am somewhat confused by some recent correspondence and productions from yourselves and my ex-colleague Mr McNamara.

Your production from Mr John Girrity is in response to your letter dated 15th October 2003. I would be grateful for a copy of your letter. Is Mr Girrity suggesting that there was no complaint? Furthermore, I note what Mr McNamara now alleges about his awareness and his epistemology : I do not agree. Finally, apart from myself and your clients being present at Edenside that night there were two witnesses to the damage, upset and threats as noted by the police.

The basic problem to your clients’ case is a simple one. It is not disputed that your clients had the painting restored but quite simply they restored the painting to the wrong artist and thereby reduced the paintings original dilapidated value.

Unless a compromise can be reached I will proceed with the Proof to which as previously intimated I intend to call six witnesses.

Your suggestion to a solution will be appreciated. Failing which I will lodge productions supporting the police involvement, the damage done, the threats made and my state of fear, and the authenticity of the painting.
